The challenge

Two parties, two narratives, one plant still to finish.

A wastewater treatment plant expansion finished well beyond its contract completion date. The contractor attributed the delay to the owner; the utility pointed to contractor performance. Each side had schedules that appeared to support its position.

With public funds at stake and the parties still working together on site, both needed an analysis they could understand and test.

Representative engagement. Client identity withheld; specifics anonymized and illustrative.

Our approach

How we turned it around

We let the contemporaneous record speak, window by window, with every step open to inspection.

PHASE 01PHASE 02PHASE 03PHASE 04
PHASE 01Reconstruct

Schedule updates, daily reports and correspondence were assembled into a verified record, with each update's data date and logic changes documented.

PHASE 02Analyze

Windows analysis traced the critical path through each period and identified what moved it.

PHASE 03Apportion

Delay was allocated between the parties, including periods of concurrency, on stated and consistent criteria.

PHASE 04Resolve

Findings were presented in plain terms designed to support negotiation rather than prolong it.

What changed

The difference we made

The parties moved from entrenched positions to a settlement grounded in the record.

Result 01An analysis both sides could test

A transparent method with every assumption stated.

Result 02Fair apportionment

Delay allocated on evidence rather than assertion.

Result 03Relationship preserved

Settlement reached without the cost of formal proceedings.
